3. Cremation Services in Sydney, NSW – Regulations

Regardless of where in Australia a cremation takes place, the cremation process will involve a number of fairly routine steps. However, there are additional rules for cremations that vary from state to state.

In NSW, cremations are governed by the Cemeteries and Crematoria Act 2013, the Cemeteries and Crematoria Regulations 2014, the Public Health Act 2010 and the Public Health Regulation 2012.

Under this legislation, the following rules apply to Sydney cremations:

• cremation of a body must be commenced within 4 hours of delivery to the crematorium (unless the body is placed in a holding room);
• prior to cremation, pacemakers and similar devices must be removed from the body;
• the body must be contained in a coffin (and both are cremated);
• only one body may be cremated in a crematory retort at any one time;
• a cremation should not take place against the deceased’s (written) directions;
• a cremation should not take place if the body is not identified.
