3. Cremation Services in Brisbane, Queensland – Regulations
Regardless of where in Australia a cremation takes place, the cremation process will involve a number of fairly routine steps. However, there are additional rules for cremations that vary from state to state.
In Queensland, cremations are governed by the
Land Act 1994, Land Regulation 2009, Cremations Act 2003 and Department of Natural Resources and Mines Policy (PUX/901/653) “Burial on land administered under the Lands Act 1994”.
Under this legislation, the following rules apply to Brisbane cremations:
- the deceased’s written instructions regarding cremation should be followed by their legal representative if that representative knows of the instructions
- a person wanting to be cremated should make provision for the cremation in their will;
- the cremation authority has the right to bury unclaimed ashes after one year;
- cremated remains may be divided between interested parties and disposed of in different ways.
