Why is it important to have a Will?
A Will is a legal document that states your wishes that are to be executed upon your passing. It ensures that your assets and affairs will be distributed and looked after as you want them to be.
If you have a partner, children, pets, or any assets, you should really make a Will.
What happens if you die without a Will?
If you die without a Will (or “intestate”) not only will your affairs not be looked after exactly the way you want them to be, but it will likely be much more costly for your family to access your assets. This is why it makes sense to make a Will even if you don’t have much money or significant assets.
How much do lawyers charge to make a Will?

Are online Wills legally valid and binding?
Yes. Provided that you meet the usual requirements for creating a Will (namely, you have testamentary capacity and are of sound mind, are over the age of 18, make the Will voluntarily, and follow the required signing and witnessing formalities), a Will made online will be legally valid and binding.
How do I make a joint Will with my partner?
While it is possible to make a joint Will with your partner, it is best practice for you and your partner to make your own separate Wills. This is the approach adopted by the Gathered Here Wills platform. We do not support the creation of joint partner Wills.
When you and your partner are making your own Wills, you may wish to confer reciprocal benefits and responsibilities on each other.
What is an Executor in a Will?
An executor is responsible for carrying out (or “executing”) the wishes in your Will. This can include paying debts, closing accounts, and distributing assets to beneficiaries.
Who should I appoint as my Executor?
An executor must be over 18 years of age. People often appoint trusted friends or family members who are good with finances and administration.
In our Will, you may appoint 1 sole executor, or 2 or 3 joint executors.
What is a Guardian in a Will?
A guardian is an adult designated to care for a child under the age of 18 in the event that both of their parents pass away.
What is a Beneficiary in a Will?
A beneficiary is a person who has been named to inherit something under a Will. This may include property, money, shares or personal items.
What if I already have a Will?
Our Will contains a clause which revokes all prior Wills and testamentary acts.
Accordingly, if you make a valid Will on our platform and properly follow the signing and witnessing instructions, your new Gathered Here Will will revoke and replace your old Will.
When do I need to update my Will?
You should update your Will following any significant life events, or significant changes to your financial position.
Some of these events include:
- If you get married, separated or divorced
- If you enter into or end a de facto relationship
- If you have new children
- If any of your executors or backup executors pass away or become unable, unwilling, or unsuitable for that role
- If any of your beneficiaries pass away
- If you sell or give away an asset that you have gifted to a beneficiary
- If your financial position change and you want to rebalance or redistribute specific gifts and residual gifts
How do I change or update my Will?
One of the benefits of making your Will with Gathered Here is that you can return any time to update your Will. All you need to do is log in, update the relevant details, print your new Will, and follow the signing instructions.
Your new Will will revoke all previous Wills.
How much does it cost to update my Will?
If you engage a lawyer to draft your Will, you will likely need to pay them hundreds of dollars every single time you want to make a change or update to your Will.

Can I leave personal messages in my online Will?
On the Gathered Here Wills platform it’s easy to leave personal messages for your loved ones.
When you leave either a money gift or a personal item gift, you will have the option of attaching a personal message. These messages are compiled in a non-testamentary document that can be kept with your Will, allowing your Executor to privately pass them on to your loved ones.
Do I need a bespoke Will?
We designed our online Will to be suitable for most Australians. However, there are circumstances where a bespoke Will, personalised specifically for your situation by a lawyer, will be more appropriate than our online Will.
Some of these circumstances include when:
- Your partner or child has a condition that affects their mental capacity
- Your partner or child has a disorder or special needs
- Your partner or child has an addiction or problems handling money
- You want to leave a close family member out of your Will
- You own property outside of Australia
- Your child has serious relationship problems with their partner
- You or your partner have children from another relationship
- You or your partner operate a business or have an interest
